These Terms of Use govern your use of theacaiclub.com & our associated ordering platform at theacaiclub.com/order. By using our site, you agree to these terms. If you do not agree, please stop using our site immediately.
1. Who We Are
The Açai Club is operated by THE ACAI CLUB, with a registered address at 10a High Street, Datchet, United Kingdom SL3 9EA. Our online ordering platform is provided by EPoS Technologies Limited (Company No. 07122283), 11 Wharf Road, Enfield, EN3 4TA, United Kingdom.
2. Use of This Website
You may use our website for lawful purposes only. You must not:
- Use the site in any way that breaches applicable law or regulation
- Attempt to gain unauthorised access to any part of our site or systems
- Introduce viruses, malware, or other harmful material
- Reproduce or redistribute content without our express written permission
3. Orders & Payment
All online orders are processed through theacaiclub.com/order. By placing an order, you confirm that the information you provide is accurate & complete.
Payments are processed securely by Stripe. Once an order is confirmed & payment taken, you will not be able to cancel your order. To amend or cancel, please contact your nearest store directly as soon as possible.
Prices displayed are subject to change. We will inform you of any pricing errors before processing your order.
4. Refunds
If you believe an item does not meet the description or is of unsatisfactory quality, please contact us. We may request a photograph of the issue. Refunds for online orders will be returned to your original payment method within 5-7 business days. Cash orders must be resolved in-store.
5. Food Allergies
Our products are prepared in an open kitchen where allergens are handled. While we take precautions, we cannot guarantee that any product is free from allergens due to shared equipment & preparation areas.
If you have a serious allergy or intolerance, please contact your nearest store directly before placing an order. See our Allergens page for more information.
6. Intellectual Property
All content on this website, including text, images, logos & design, is the property of The Açai Club or its licensors. You may not reproduce, distribute, or commercially exploit any content without our express written permission.
7. Limitation of Liability
To the fullest extent permitted by law, The Açai Club accepts no liability for any loss or damage arising from your use of this website or reliance on any content published here. We make no guarantee that the site will always be available or free from errors.
8. Run Club & Your Profile
Our app has a Run Club leaderboard. If you have completed a run with us, you can see it, & you can add a photo to your profile.
Who sees your photo
Adding a photo is optional. If you add one, it is shown next to your name on the leaderboard, only to members you have actually run with. You can hide or delete it at any time in the app. You must be 16 or over to add one.
What your photo must not contain
By adding a photo you confirm that it is a photo of you, that it is yours to use, & that it does not contain any of the following:
- nudity or sexual content
- anything abusive, hateful, or aimed at another person
- a person who is under 16
- anyone other than you, unless they have agreed
- anyone else's phone number, address, or other personal details
- anything that breaks the law or infringes someone else's copyright
Reporting a photo
Every profile has a Report option. Tell us what is wrong & we will look at it, normally the same day. You can also Block another member, which hides you from each other. We do not tell them.
If you would rather email, write to [email protected] & we will treat it the same way.
If we remove your photo
We will email you to say what we removed & why. You can reply to appeal & a person, not a machine, will look at it again. If we got it wrong we will put it back. We may remove a photo without warning if it is unlawful.
Repeatedly breaking these rules may mean we stop you adding a photo, or close your account.
9. Privacy
Use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Governing Law
These Terms are governed by the laws of England & Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
